Terms of Use

“LearnTXRE.com” (“Site” or “Website”) is owned and operated by Ron and Sheila Dunagan, and Dunagan Team, LLC (collectively referred to as, “Company”, “we,” or “us”). A party who accesses, engages or uses Site, for any purpose, is herein referred to as “User”. User’s use of this site, including access to all media, materials, or services now existing or later developed (collectively, “content”) shall serve as acknowledgement and acceptance to the following Terms of Use. If you do not agree to the terms of use and/or privacy policy, you should terminate use of the Site.

1.0 PURPOSE OF THIS SITE

1.1 Educational and Informational Purposes

All information on the Site, or that which can be downloaded or streamed, including any Webinars, digital resources, services or other content, are exclusively for educational and informational purposes.

1.2 Not Legal or Professional Advice

Content accessed on the Site by User is not meant to serve as legal or professional advice.  Although the Company’s owners are real estate professionals, the content provided on the Site should not replace professional guidance the User can obtain from an attorney, accountant, engineer or other professional advisor. 

2.0 USE OF THE SITE

2.1 User Bears All Risks

User agrees to bear all risks associated with the usage of the Site. The Company makes no representations, warranties, guarantees, statements, or assertions on which the User may rely.  Company strives to ensure the accuracy and usefulness of the information and resources provided on the Site. However, the Company does not make any representations or warranties regarding the accuracy of the content, nor does Company make any commitment to update the content. 

2.2 No Client Relationship

Use of the Site does not establish a client relationship between User and the Company.

2.3  Linked Sites

The Site may include links to other sites operated by third parties.  While Company takes reasonable steps to select and provide links that add value to the Site, Company is not responsible for the content contained on any linked site.  Furthermore, unless expressly indicated otherwise, the Company does not endorse, approve, or otherwise warrant the accuracy of any information contained on a linked site. You should review the terms and conditions of use and the privacy policy of the linked site before using that site.

2.4 Recording of Webinars and Seminars

By participating in Site webinars or seminars, User consents to being recorded.  The company retains the right to use these recordings for training or marketing purposes.  User waives the right to any claim of compensation.  The company owns all rights to such recorded materials and may use them at its discretion without further obligation to the User. The User is not authorized to record any sessions without prior written consent.

2.5 Testimonials

The Site may display testimonials from Users. When displayed, these testimonials reflect real experiences and outcomes, but are not to be interpreted as a guarantee of similar success or outcomes.

3.0  COMMUNICATION

3.1 Express Written Consent

By submitting User’s contact information on any contact form associated with the Site, User is providing express written consent to receive communications from us.  By providing this information User is representing that: a) User is at least 18 years of ageb) User lives in the United Statesc) User has not registered on a national or statewide Do Not Call list d) The email and phone number User provided is accurate

3.2 Methods of Communication

By providing your E-mail address User consents to receive E-mails from Company regarding services, newsletters, promotional offers and updates. By providing your phone number User consents to receive SMS text messages from Company regarding services, newsletters, promotional offers and updates. 

3.3 Opt-Out

User may revoke consent to receive communications from the Company at any time.  The Company will make a reasonable effort to comply with any communications from the User opting out. User can opt-out of text messaging by replying “STOP” to any of the Company’s texts. User consents to receive a final text message to confirm an Opt-Out request.

3.4 Frequency

The frequency of communications sent to the User may vary. 

4.0 Claims or Legal Action

4.1 Limitation of Liability

User releases Company from all liability or loss incurred by the User as a result of accessing the information and resources on the Site.  User acknowledges that the Company will not be held liable for any damages, whether direct, indirect, incidental, special, or consequential, arising from the User’s access to the Site.  

4.2 Waiver of Claims

User waives and agrees to forego any claim User may have now or in the future against the Company arising from the User’s use of Site. Company may prohibit, block, or otherwise terminate User’s access to the Site at any time, for any reason, at the sole discretion of the Company.  

4.3 User's Waiver of Jurisdiction

User waives and agrees to forgo any objection to the jurisdiction of a court located in Dallas County, Texas in any action in which the Company is a party. Should a legal action arising from or in any way related to this agreement be initiated, User shall be liable and responsible for all costs and expenses, including attorney’s fees, incurred by the Company in connection with or related to said legal action.

4.4 Unauthorized Use

User is liable for any unauthorized use of the Site.  User agrees not to use the Site for illegal activities, harvesting data, introducing harmful software, or scraping.  

4.5 Modification of Terms

Company reserves the right to change, add or remove portions of the Agreement at any time.  Any such modification of terms shall become effective immediately upon posting. It is your responsibility to review the terms prior to each use of the Site.  By continuing to use the Site, you agree to the most recent terms posted.
